Terms of service

Effective date: 2026-07-17

These terms govern use of the Argo Navis Platform (the "Service"), operated by Argo Navis ("Argo Navis", "we", "us") at wa.argo-navis.net, by a business that creates an account ("you", the "business customer"). By creating an account or using the Service, you agree to these terms.

1. The service

Argo Navis provides a dashboard and API for businesses to connect their own WhatsApp Business Account and phone number(s) via Meta's Embedded Signup, and to send and receive WhatsApp messages, manage message templates, organize contacts, run structured automations, and view analytics for their own account. Argo Navis acts as a WhatsApp Business Solution / Tech Provider on Meta's platform: we operate on WABAs and phone numbers you explicitly connect, and never on assets you have not authorized.

2. Acceptable use

You are solely responsible for the messages you send through the Service and for the contacts you message. You agree to:

  • Comply at all times with Meta's WhatsApp Business Messaging Policy, WhatsApp Business Terms of Service, and the Meta Platform Terms, as amended from time to time.
  • Only message people who have opted in to receive messages from your business through an appropriate mechanism, and honor opt-outs promptly.
  • Not use the Service to send spam, unsolicited bulk messages, or messages that violate applicable anti-spam, telemarketing, or data protection law.
  • Not use the Service for illegal, fraudulent, deceptive, or harmful purposes, including phishing, malware distribution, or impersonation.
  • Not attempt to circumvent Meta's rate limits, quality ratings, or messaging tiers.
  • Keep your account credentials and any API keys confidential and notify us promptly of any suspected compromise.

We may suspend or terminate accounts that violate this section, including where required to do so by Meta or to protect the Service's standing on the WhatsApp Business Platform.

3. Dependency on Meta's platform

The Service is built on top of the WhatsApp Business Platform and, where used, Facebook Login — both operated by Meta Platforms, Inc. Meta may change its APIs, policies, pricing, rate limits, or availability at any time, and may suspend or restrict access to your WhatsApp Business Account or our application independent of anything we do. We are not responsible for outages, feature changes, policy enforcement actions, or account restrictions originating from Meta, and we will pass through material changes we are made aware of, but we cannot guarantee advance notice of changes Meta makes unilaterally.

4. Availability

We aim to keep the Service available and reliable but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance, and may experience unplanned downtime, including downtime caused by upstream dependencies (Meta's platform, our hosting provider, Cloudflare).

5. Fees

Fees, if any, for use of the Service are as agreed separately with you. You remain responsible for any charges Meta bills directly for WhatsApp conversation-based pricing on your own WABA, independent of any fees you pay us.

6. Data and privacy

Our handling of data is described in the privacy policy, which is incorporated into these terms by reference. As between you and us, you remain the controller of your own contact and message data; we process it on your behalf to provide the Service.

7. Intellectual property

We retain all rights in the Service's software, design, and branding. You retain all rights in your own content, contact data, and message content. You grant us a limited license to process that content solely to provide the Service to you.

8. Disclaimers and limitation of liability

The Service is provided "as is" and "as available", without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement, to the fullest extent permitted by law. To the fullest extent permitted by law, Argo Navis will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or lost data, arising from your use of the Service.

9. Termination

You may stop using the Service and close your account at any time from account settings or by emailing jason@argo-navis.net. We may suspend or terminate your account for breach of §2, non-payment of any agreed fees, or if required to do so by Meta. On termination, your data is handled as described in the privacy policy retention section and our data deletion instructions.

10. Governing law

These terms, and any dispute arising from them, are governed by the laws of the jurisdiction in which Argo Navis is established, without regard to conflict-of-law principles, and the parties submit to the exclusive jurisdiction of the courts located there.

11. Changes to these terms

We may update these terms from time to time. Material changes will be reflected by updating the effective date above. Continued use of the Service after an update constitutes acceptance of the revised terms.
